If we modify these Terms, we’ll post the revisions on our Website. We may try to notify you when that happens, but it’s best to periodically review the most up-to-date versions. If you participate in our Website or services after we post changes that means that you’ve accepted all revisions to date, regardless of whether you receive notice of them.
If we send you communications like new-feature announcements or administrative messages, or if our sponsors post ads on our Website, you may not be able to opt out of receiving these messages.
We may take the following actions for any reason without notifying you beforehand:
1) Change, suspend, or discontinue all or part of our services;
2) Restrict, suspend, or terminate your account or your access to the Online Community;
3) Refuse, move, or remove any material that you submit to us;
4) Refuse, move, or remove any other content that is available through our Community;
You agree that we will not be liable to you or anyone else for taking any of these actions.
2. Our Community Participants
Visitors are any persons who limit their interaction with our Website to reading Content or downloading blog or other posted information. Visitors, as everyone else who accesses our Website, must agree to and abide by our Community Policies.
Members are individuals who participate in our Community by asking questions, making comments, providing testimonials, rating blogs or Sponsors, posting to our discussion Forums, posting blogs, or in any other way actively interacting with our Website. To become a member you must join, which requires very little personal information and a valid email address.
Sponsors are business that may be able to help area residents reduce their energy use. They pay for the right to: present advertisements; be listed as a Sponsor and have a sponsor page; and on occasion provide blog content. Whenever a blog has been contributed by a sponsor or one of its employees or volunteers, it should be marked with a “Sponsor Content” symbol in the top right of the blog’s first page to indicate to readers that this content is in part an advertisement.
We encourage individuals and Sponsor employees or volunteers who have expertise or experience to become Contributors by contributing content that we hope our readers and members will find helpful. OEIC does not, however, determine Contributors’ level of expertise and there are no certifications, tests, or other reviews to validate the assertions and opinions in Contributors’ content. Each reader must make his or her own determination on whether what is being presented on this Website (Content) is helpful to the reader’s particular circumstance.
3. About the Content
Our Website offers Content created by OEIC employees and volunteers, our Sponsors and their employees and volunteers, our Members, and other Contributors. This Content may include blogs or forum posts, comments, ratings, testimonials, questions, white papers, information about environmental or energy news, activism and social justice issues, interviews, and product or service reviews. We may also display information about products and services offered by third parties, such as product descriptions, specifications, pricing, or reviews.
OEIC can’t guarantee the accuracy, integrity, or quality of any Content posted by our Contributors and you agree not to hold us liable for damages you may sustain because you relied on any of this content. In particular, we aren’t responsible for Contributors’ posted opinions and their advice about potentially dangerous activities or the use of dangerous tools or materials; be sure to get professional assistance when performing home improvements.
The individual who posted the Content is solely responsible for what is posted, any opinions expressed are his or hers and not necessarily the opinion of OEIC or its employees or volunteers.
If you discover content in our Online Community that you consider offensive, indecent, inaccurate, or objectionable, you bear all risks associated with using that content. We have the right, but not the obligation, to remove any content that we think violates these Terms or that we consider being otherwise objectionable.
4. Third-Party Web Sites, Products, and Services
If our Website contains a link to some third-party website, that doesn’t mean we endorse that site. We have no control over those sites and can’t be responsible for any content on them or damages you may suffer because you visit them. Your use of a third-party website is subject to its own Terms of Service and other policies.
We don’t sell, resell, or license any third-party product or service that may be reviewed, described, or advertised in our Website. So we disclaim any responsibility for or liability related to those products and services. Any questions, complaints, or claims related to such a product or service should be directed to the appropriate third-party vendor.
We encourage members to contribute their own stories, advice, references, and other information to our Website. Some of the easiest ways to become a Contributor are to: comment or ask questions in a blog post that interests you; respond to or open a discussion Forum topic; or “Ask Dan” if a new Forum chapter or category is appropriate for you to post in. If you want to provide more formal or longer posts contact Dan Gibson (OEIC Reporter and Chief Coordinator) at DanG@OEIC or the Blog Team Coordinator of the blog to which you are interested in posting, to discuss topics and the logistics of posting to a blog.
Contributors own all copyright rights in their Contributions, but agree to license to OEIC:
i) the non-exclusive worldwide right to copy or distribute all or part of your Contribution in any existing or future medium;
ii) the non-exclusive right to maintain your Contribution in perpetuity in a searchable Online Community archive.
Contributors have the right to reuse their original Contributions in any form. If we republish your Contribution, we’ll always include your byline unless you notify us that you’d rather we didn’t.
Our goal is to not interfere with or alter member’s content. But remember that when you make materials available to our Website, you acknowledge there may be unusual cases where it’s necessary for us to edit your content for style, grammar, punctuation, length, or organization according to our general Website standards. You also grant us the right to crop, edit or resize photographs and other graphic content when we find it necessary.
Contributors guarantee that their Contributions, including all text, figures, illustrations, photographs, and tables, are their original work and don’t libel anyone or infringe upon another party’s copyright, trademark, property rights, or any other rights, including rights of publicity and privacy. If a Contribution does contain another party’s copyrighted work, the Contributor must obtain permission to use that work and submit that permission with the Contribution. Contributors also guarantee that, to the best of their knowledge, their contributions are not scandalous, obscene, libelous, or otherwise illegal.
If a Contribution results in a legal action or controversy with some third party, the Contributor agrees to indemnify, defend, and hold OEIC harmless against all claims, suits, and/or judgments, including costs, expenses, damages, and legal fees.
